Court (Shar’iyya) recordings are at the forefront of primary written sources, which contain important documents related to Turkish history, sociology and culture. The court records shed light on city history of the period concerned with rich information and documents. These records are important books in which the documents related to the judicial, administrative, economic, architectural and social structure of a city as well as diplomatic correspondence between the center and the province were recorded. The purpose of this study is to (...) prepare a detailed catalog in addition to the catalog which was made in 1963 and contained only 119 books specifying only the dates covered by the book number. As we have seen in this study, all of the 119 notebooks in the records do not consist of the court registers in the known form. They are the books that include the records of court proceedings, which are different from those of the court, especially after the Tanzimat e.g. Qassam, Enkiha, Zabt al-Da’wa, Permission and so on. The microfilms of the books were presented to the service of researchers in Sivas Ziya Bey Library of Ancient Works. In the Bursa inscription, which dated to 1337/8, the second Ottoman Sultan (Sulṭān) Orhan was titled as the mujahedeen (warrior), the sultan of the veterans, son of veteran of veteran. The fact that Orhan carring these titles shows that since the earliest times, the Ottoman sultans considered themselves as the leader of the religious war against the infidels. Since the first years of the establishment of the Ottoman State, the Sharīʿa ruled on the establishment of administration and for this reason, they established institution of the Shaykh al-Islām(the chief juristconsult). Firstly, by appointing a subaşı(subashi, an Ottoman gubernatorial title) to the conquered places, then it gradually began to establish judicial courts from the smallest areas.In the XVth century, the number of qāḍī increased in parallel with the increase in their jurisdiction as a result of the expansion of the Ottoman Empire, and the proliferation of the administrative units called sancak, (sanjaq, division of a province) and so the failure of oneqāḍīto satisfy court affairs of an entire sanjaq. New districts arose from some of the former large districts. As a result of this in the XVIth century, the administrative system of the sanjaq's Tımar system and at the same time a geographical integrity of the districts/provinces to see the legal work of a qāḍī to pass by the districts and sub-district as a legal caused to occur two legal definitions that is legal and military administrative. Records of qāḍīs, which is called as sicilemerged because it was their duty to record their works and orders issued to them and the answers and the provisions given to them.The courts of Shar’iyyaserved as primary general courts (maḥākim-i ʿumūmiye) until the declaration of the Tanẓīmāt in the Ottoman Empire and heard the suit at legal, criminal, administrative, military, financial and all kinds of cases. Tanẓīmāt period, or rather Maḥmūd II and the period following him, the judicial organs in terms of reorganization was a circuit that was on the scene.In this way, which was occurred in the judicial system, records which were kept in the Meşihat (Mashīkhat) began to diversify depending on this change. Since in the registry books, which we call classical, all correspondence between the central and provincial offices were recorded. Records such as pleas, letters of patent, verdicts, order of the high, bonds etc. could be found in these documents.These records, which are one of the most important sources of an Ottoman city history, were kept in the museums and libraries of the cities until recently. A few years ago, these records, with a correct decision, were collected in the Prime Ministry Ottoman Archives and it was preserved and presented to the use of researchers by transferring them into digital. The Sivas Court building as it is known in history is now in the Pāshābeg quarter and known as the Court Bazaar in these days. There is no clear information about when the court was built in Sivas. In time, changes have occurred in cities and we are losing the historical side of them. In addition, the fact that people acted in an unconscious manner that would harm the historical texture was the biggest factor in disappearance of material remains. With the remaining physical materials available, we can only access crumb information and we can only make predictions. In this evaluation, the biggest materials are the documents and notebooks, which are the memory of city dates. However, it is understood from the records that there is a foundation belonging to this court and some of the court's repair and maintenance works were carried out by this foundation. As it is understood from a document dated 14 August 1798, one of the repairs was sponsored by Ḥüseyin Efendī. In an inscription dated 1906, which was found during the renovation of the basement of an apartment building owned by the General Directorate of Foundations in May 2018, the location of the building was previously known as the Sivas Muftī 's Office.In this study, a total of 240 registry books belonging to Sivas were prepared as in a catalog system. In this study, we have seen that a great deal of records have been lost, burnt or destroyed in a certain way through history. The burn marks in the records of 79 is a striking example in this regard. The book number 139, which is not shown in Osman Ersoy's work, is a record book in classical form. An important case in this study is that the register number 206, which is registered to Sivas, belongs to the province of Burdur and it is also a registry book in classical form. This book covers the dates of 18 M. 1248/23 N.1250 - 1832-1835. (shrink)

Ebu’l-Ḥajjāj Yusuf b. Muhammad al-Miklâtî is an Ash’arî scholar who lived between the years 550-626 (1155-1229). He has a work entitled Lubāb al-ʿuqūl fī radd ʿalā al-falāsifa fī ʿilm al-uṣūl to defend the opinions of Ahl al-Sunnah by criticizing philosophical views. Miklātī is one of the most important figures who lived in the Muvahhidī state. He is a professor who contributed to learning of Ash’arī kalām system in the North Africa and Andalusia. But today it has not been demonstrated. Therefore, (...) in this article we looked at some theological views of Miklātī in the context of his criticism of the philosophical views.Ebu’l-Ḥajjāj Yûsuf b. Muhammad al-Miklātī is an Ash’arī scholar who lived in North Africa and Andalusia between the years 520-626 (1155-1229). He is one of the tutors working at madrasahs of the Muvahhidī state established by Ibn Tumart. Becoming meeting point of Salafī and philosophical understanding is one of the main factors which makes important the period and the region where he lived. Muvahhidīs on the one hand called for the returning to the Book and the Sunnah, and ordered to burn the works of Malikī fuqahā related to the branches (furūʿ) with the reason that they became distant from the Qur’an and the Sunnah. On the other hand, the last great represantatives of Islamic Philosophy, Ibn Tufayl and Averroes wrote their most precious works at Muvahhidî palace.Only extant work of al-Miklâtî is Lubâb al-‘uqûl fî radd ‘alâ al-falâsifa fî ‘ilm al-uṣûl. In Lubâb al-‘uqûl, al-Miklâtî by giving a place to the philosophical opinions about theology, prophethood and the hereafter criticizes the viewpoints of Aristotle, from Periphatetic philosophers al-Fârâbî and Avicenna, from Mu’tazilah Abu Hudhayl al-‘Allaf and Qa’bî. He has benefited from the works of Ash’arî theologians like Baqillanî, al-Juwaynî and al-Ghazzâlî when he make criticism. Especially in the theology section, when he considers some subjects he has followed the method which al-Ghazzalî used in his Tahâfut which was written to criticize the philosophers. However, with the impact of the fuqahâ, who has Salafî understanding, and that of the Islamic philosopher Averroes, the ruler of the region ordered to burn the works of al-Ghazzâlî and notify that whoever has these works will be killed and whose wealth will be seized. In this regard al-Miklâtî’s work has an important contribution to the settlement of Ash’arî theology against Salafî and philosophical opposition.The main reason of the opposition of Salafî understanding towards the science of Kalâm is the claim that Kalâm has been established through outward impacts at a philosophical basement. The main reason of opposition of Averroes towards Kalâm is that Kalâm follows argumentative (jadalî) methods not instead of demonstrative ones (burhânî). This work of al-Miklâtî provides benefits to the establishment of Kalâm with the hands of Muslims and on the Qur’anic base and also has contributed to the development of a demonstrative tradition against philosophical opposition. Because according to him, the purpose of a theologian is to declare the demonstrative proofs which help for the soundness of the religious creed. The geometrical elements in the architecture of Lincoln Cathedral, in the vaulting and elevations, can be compared to the geometries described by Robert Grosseteste in his cosmologies. The architecture can be read as a catechism of the cosmologies. The geometries appear in the cathedral for the first time in the history of architecture to explain the generation, emanation, reflection, refraction and rarefaction of light as it forms the material world. The proposition is that the geometries of the architecture of Lincoln (...) Cathedral can be understood in relation to the geometries which are the basis of the cosmologies of Robert Grosseteste, Bishop of Lincoln 1235–53, in particular De lineis, angulis et figuris, and De luce. Many of the architectural forms at Lincoln Cathedral are unprecedented in their appearance or use, and they form the basic vocabulary for the entire development of English Gothic architecture. Their radically new appearance has never been adequately explained. Vocabulary elements such as the ridge pole, tierceron or non-structural rib, lierne or segmented ridge rib, flying rib, conoid springer vault or cone of ribs rising from the springer pole in the elevation, triradial vaulting or three ribs meeting at the ridge pole, double syncopated or overlapping arcading, and the bundled and ribbed umbrella column, all originate in some form or are developed for the first time in Lincoln. All of the geometries which appear for the first time in the architecture appear in the cosmologies of Grosseteste, for the purpose of explaining the generation, emanation, reflection, refraction, and rarefaction of light as it forms the material world in geometrical configurations. The cathedral would thus be a catechism of the geometrical substructure of the physical world, in the tradition of the Timaeus of Plato. There is no evidence that the concepts were dictated by Grosseteste directly to masons, but it is well known that such concepts permeated medieval architecture and city planning, and that they were filtered down through all trades involved in construction of the city and the cathedral. Grosseteste’s cosmologies represent a core achievement of Scholasticism, the synthesis of classical philosophy and Catholic theology, which is embodied in the architecture of the cathedral. (shrink)

Does a proper understanding of the role of philosophical inquiry and its re- lation to scientific inquiry entail that we should replace conceptual analysis with another methodology? Brian Leiter supports that conclusion by offer- ing a methodological criticism of recent analytical legal philosophy. According to Pew Research studies, most Americans think religion always conflicts with science. The popular writings of scientists such as Richard Dawkins, Sam Harris, and Lawrence Krauss reinforce this idea, as do books by writers such as Christopher Hitchens and Daniel Dennet. Furthermore, the two versions of the enormously popular television show Cosmos, hosted by Carl Sagan in 1980 and Neil deGrasse Tyson in 2014, present a history of science in which religion has always acted as a barrier to scientific (...) development, with scientists frequently persecuted or even executed for their work. "Gods, Philosophers, and Scientists" shows that just because an idea is popular, doesn't mean it's correct. By examining the historical record from the time of the Ancient Greeks to today, readers are able to see that religion and science have been allies more often than enemies, and when conflict does occur it's too simplistic to view it as coming from something inherent to either science or religion. Instead, as with the case of Greek philosophy or the reception of Darwinian evolution, complex social forces are to blame, and in cases such as the infamous one of Galileo's conflict with the Catholic Church, clashing personalities are at least as important as those social forces. Anyone interested in the history of science or religion, who is curious about how science works, or who wants to have a better understanding of the world should read this book. (shrink)

Industry-funded religious liberty legal groups have sought to undermine healthcare policy and law while simultaneously attacking the rights of sexual and gender minorities. Whereas past scholarship has tracked religiously-affiliated healthcare providers’ growing political power and attendant transformations to legal doctrine, our account emphasizes the political donors and visionaries who have leveraged religious providers and the U.S. healthcare system’s delegated structure to transform social policy and bureaucratic agencies more generally.

In a previous paper, an elementary and thoroughly arithmetical proof of Fermat’s last theorem by induction has been demonstrated if the case for “n = 3” is granted as proved only arithmetically (which is a fact a long time ago), furthermore in a way accessible to Fermat himself though without being absolutely and precisely correct. The present paper elucidates the contemporary mathematical background, from which an inductive proof of FLT can be inferred since its proof for the case for (...) “n = 3” has been known for a long time. It needs “Hilbert mathematics”, which is inherently complete unlike the usual “Gödel mathematics”, and based on “Hilbert arithmetic” to generalize Peano arithmetic in a way to unify it with the qubit Hilbert space of quantum information. An “epoché to infinity” (similar to Husserl’s “epoché to reality”) is necessary to map Hilbert arithmetic into Peano arithmetic in order to be relevant to Fermat’s age. Furthermore, the two linked semigroups originating from addition and multiplication and from the Peano axioms in the final analysis can be postulated algebraically as independent of each other in a “Hamilton” modification of arithmetic supposedly equivalent to Peano arithmetic. The inductive proof of FLT can be deduced absolutely precisely in that Hamilton arithmetic and the pransfered as a corollary in the standard Peano arithmetic furthermore in a way accessible in Fermat’s epoch and thus, to himself in principle. A future, second part of the paper is outlined, getting directed to an eventual proof of the case “n=3” based on the qubit Hilbert space and the Kochen-Specker theorem inferable from it. (shrink)

On 26 August 1974, Michel Foucault completed work on Discipline and Punish, and on that very same day began writing the first volume of The History of Sexuality. A little under ten years later, on 25 June 1984, shortly after the second and third volumes were published, he was dead. This decade is one of the most fascinating of his career. It begins with the initiation of the sexuality project, and ends with its enforced and premature closure. Yet in 1974 (...) he had something very different in mind for The History of Sexuality than the way things were left in 1984. Foucault originally planned a thematically organised series of six volumes, but wrote little of what he promised and published none of them. Instead over the course of the next decade he took his work in very different directions, studying, lecturing and writing about historical periods stretching back to antiquity. This book offers a detailed intellectual history of both the abandoned thematic project and the more properly historical version left incomplete at his death. It draws on all Foucault’s writings in this period, his courses at the Collège de France and lectures elsewhere, as well as material archived in France and California to provide a comprehensive overview and synthetic account of Foucault’s last decade. This essay considers the relationship between ideal theory and non-ideal theory. It begins with Rawls’s conception of ideal theory and A. John Simmons’s articulation of non-ideal theory. Both defend the priority of ideal theory over non-ideal theory. The essay then considers three different conceptions of the social barriers standing in the way of an ideal society, taken broadly from Mill, Marx, and Foucault. Each conception of power suggests a divergent strategy for pursuing non-ideal theory. The Foucauldian conception also suggests reasons (...) to mistrust our own political and moral judgments. The essay advocates a more limited view of the relationship between ideal and non-ideal theory than is commonly described, in which ideal theory retains its logical priority but not its temporal priority. In other words, the essay argues that we will fare best when we focus first on reducing specific injustices while setting aside further speculation about the character of an ideal society. (shrink)

A proof of Fermat’s last theorem is demonstrated. It is very brief, simple, elementary, and absolutely arithmetical. The necessary premises for the proof are only: the three definitive properties of the relation of equality (identity, symmetry, and transitivity), modus tollens, axiom of induction, the proof of Fermat’s last theorem in the case of n = 3 as well as the premises necessary for the formulation of the theorem itself. It involves a modification of Fermat’s approach of infinite descent. (...) The infinite descent is linked to induction starting from n = 3 by modus tollens. An inductive series of modus tollens is constructed. The proof of the series by induction is equivalent to Fermat’s last theorem. As far as Fermat had been proved the theorem for n = 4, one can suggest that the proof for n ≥ 4 was accessible to him. An idea for an elementary arithmetical proof of Fermat’s last theorem (FLT) by induction is suggested. It would be accessible to Fermat unlike Wiles’s proof (1995). (shrink)

Review of Ronald Dworkin, Religion without God , (Harvard University Press, 2013), 180 pages.

George Berkeley (1685-1753) is, with John Locke and David Hume, one of the three major figures in the British empiricist school of philosophy. He has been the centre of much attention recently and his philosophical profile has gradually changed. In the 20th century he was almost exclusively known for his denial of the existence of matter (as this term was defined in those days), but today it is no longer reasonable to confine an account of Berkeley to the challenging philosophical (...) inventions that he published when he was a young fellow at Trinity College in Dublin. This is a welcome trend. It shows Berkeley as a contributor not only to epistemology, metaphysics and moral and social philosophy, but also to a wide range of subjects including mathematics, philosophy of science, empirical psychology, political economy and monetary policy. The present collection aims at meeting this new trend by presenting a broad and comprehensive picture of Berkeley's works in their historical context. The contributors are some of the finest international experts in the field. The editors hope that this collection will show George Berkeley as he was: a wide-ranging, widely influential and courageous philosophical innovator. Russell's version of the multiple-relation theory from the "Theory of Knowledge" manuscript is presented and defended against some objections. A new problem, related to defining truth via correspondence, is reconstructed from Russell's remarks and what we know of Wittgenstein's objection to Russell's theory. In the end, understanding this objection in terms of correspondence helps to link Russell's multiple-relation theory to his later views on propositions.

It is through the dialectics of form and function in architecture, and in particular in the contradiction between the two, that the artistic and aesthetic dimensions of architecture can be developed: its expression of ideas, reflection of human identity, its ethics of responsibility to engage human culture, and its beauty. Architecture is capable of facilitating intellectual development, and of expressing ideas which transcend its material, programmatic and structural functions; in short, architecture is capable of being art, or poetry. Through its (...) forms, and in the dialectic between form and function, architecture is capable of expressing important aspects of individual and cultural identity, as a humanistic art form. We study Fermat's last theorem and Catalan's conjecture in the context of weak arithmetics with exponentiation. We deal with expansions of models of arithmetical theories (in the language ) by a binary (partial or total) function e intended as an exponential. We provide a general construction of such expansions and prove that it is universal for the class of all exponentials e which satisfy a certain natural set of axioms. We construct a model and a substructure with e total (...) and (Presburger arithmetic) such that in both and Fermat's last theorem for e is violated by cofinally many exponents n and (in all coordinates) cofinally many pairwise linearly independent triples. On the other hand, under the assumption of ABC conjecture (in the standard model), we show that Catalan's conjecture for e is provable in (even in a weaker theory) and thus holds in and. Finally, we also show that Fermat's last theorem for e is provable (again, under the assumption of ABC in ) in “coprimality for e”. (shrink)

Claudian of Alexandria's last datable poem, the Panegyric on the Sixth Consulship of Honorius, was delivered in Rome in 404, presumably on 1 January. This performance occurred in the course of the first visit to Rome by an emperor for nearly a decade and a half. Imperial visits to Rome were notoriously rare in the fourth century and, in a well-known passage of that poem, the goddess Roma herself muses on their rarity: she had only seen an Augustus three (...) times in the last hundred years. This is not quite true, but the only legitimate emperors known to have paid formal visits to Rome in that period were Constantine in 312–13, 315 and 326, Constantius II in 357, and Theodosius I, accompanied by his four-year-old son Honorius, in 389. In this article I shall begin by making an observation about the court's intentions in moving to Rome in late 403, and then deal with two problems bound up with the interpretation of this poem and with the circumstances of imperial visits. The first problem concerns the visit of Honorius during which the poem was first performed. In Claudian's narrative the description of Honorius' triumphal entry leads into a description of his assumption of the consulate, and scholars have sometimes asserted that he made a triumphal entry as consul on 1 January 404. This is clearly wrong: Honorius arrived in Rome weeks or months before. But even when this point is recognized, it is often asserted that the poem blends triumphal and consular imagery, and elements of the triumphal entry are confused with the assumption of the consulship. My argument therefore moves from the chronology of Honorius' visit to elucidating the structure and imagery of Claudian's poem, as well as casting light on the patterns of the late antique imperial aduentus more broadly. The second problem concerns the description of Honorius' previous visit to Rome with his father in the summer of 389. Here it has sometimes been inferred on the basis of Claudian, and of late chronicles, that Honorius was created Caesar by his father on 13 June, the day of the aduentus. I shall show on the basis of a critical examination of the chronicle tradition, as well as a survey of contemporary numismatic, epigraphic and literary evidence, that this belief is unfounded, and that the relevant passages of Claudian require a different interpretation. However, this evidence also makes clear that signals were being sent in 389 about Honorius' imperial future. (shrink)

This book contains the text of Thomas Kuhn's unfinished book, The Plurality of Worlds: An Evolutionary Theory of Scientific Development, which Kuhn himself described as "a return to the central claims of The Structure of Scientific Revolutions, and the problems that it raised but did not resolve." The Plurality of Worlds is preceded by two related texts that Kuhn publicly delivered but never published in English: his paper "Scientific Knowledge as a Historical Product" and his Shearman Memorial Lectures, "The Presence (...) of Past Science." The book opens with an introduction by the editor that describes the origins and structure of The Plurality of Worlds, and sheds light on its central philosophical problems. Kuhn's aims in his last writings are bold. He sets out to develop an empirically grounded theory of meaning that would allow him to make sense of both the possibility of historical understanding and the inevitability of incommensurability between past and present science. Moreover, he intends to show that incommensurability is fully compatible with a robust notion of a real world that science investigates, with the rationality of scientific belief change, and with the idea that scientific development is progressive. This is a must-read follow-up to The Structure of Scientific Revolutions, one of the most important books of the twentieth century. (shrink)

This group of notes translated in this book is not complete for the year 1886. There are at least two other notebooks that were done in the year 1886. However, Nietzsche wrote in his notebooks sometime from back to front and currently the notebooks are only in a general chronological order. Refer to the (...) On April 18, 2019, a small group of Peirce scholars arrived in Milford, the small Pennsylvania town where Charles and Juliette Peirce spent the last few decades of their lives. The purpose of the gathering was to dedicate the monument to Charles Peirce that had been completed some months before, in August, at the Peirce gravesite in the Milford Cemetery. Slavoj Žižek is one of the most influential philosophers of our current age. His work as a whole largely draws from Platonic, Cartesian, Hegelian and Lacanian thought, and has been applied to the analysis of empirical sciences, political-economic theory, as well as contemporary spirituality and theology. Jordan Peterson is a well respected clinical psychologist and has recently become one of the most influential public intellectuals of our current age. His work as a whole largely draws from Christian, Nietzschean, Jungian and (...) Piagettian thought, and has been antagonistically situated in contemporary debates on the nature of gender identity, sexual expression, communist ideology, and the importance of responsibility for a meaningful life. During Peterson’s rise to global fame these two thinkers have often been symbolically positioned by those familiar with their work as figures in an oppositional determination : Žižek standing for the future of the progressive left and revolutionary communist values, and Peterson standing for the future of the conservative right and traditional patriarchal values. In this work it is argued that the difference internal to this antagonistic positioning can be put to a productive utility. Towards this end I first attempt to use Christianity, Postmodernism and Psychoanalysis as thematic structures to focus on their core differences. Secondly, I attempt to summarize the major points of agreement that emerged from their public debate/dialogue/discussion. These two goals are established to demonstrate the importance of higher order dialogue capable of reconciling opposed figures of consciousness. Such reconciliation would not represent a synthesis to erase all differences, but rather a reconciliation that would open new spaces of productive discourse capable of approaching the nature of psychology and society. At the time of his death in 1984, Foucault’s late career forays into Stoicism and other sets of ancient texts were often little understood, except as part of a larger project on the history of sexuality. Indeed, outside of France and outside of an incipient queer theory, Foucault was often taken up in terms of debates over post-structuralism and postmodernism—themes all but absent from his writings. More than thirty years later, after the publication of all of his lecture courses at (...) the Collège de France from 1970-1984 as well as his collected writings, we have gained a better understanding of the deep continuities in his set of concerns from Histoire de la folie à l’âge classique to the third volume of his history of sexuality series, Le Souci de soi. Yet many Foucault scholars continue to see momentous shifts in his writings, e.g., from knowledge to power to ethics, and the almost bewildering range of texts he covered in the years after finishing the first volume of his history of sexuality series, La Volonté de savoir, lead to very different interpretations concerning what Foucault was attempting to do and how much his rendering of ancient texts differed from his own claims. Stuart Elden’s Foucault’s Last Decade steps into this breach, using archival work to fill in many of the details of this period, from when and on what Foucault was lecturing to listing those with him in that amusing late photo of a beaming Foucault in an ill-fitting cowboy hat. The publication of Elden’s book marks a good time to assess this often misunderstood period in Foucault’s work, and we have gathered Stuart Elden and two more of Foucault’s best interpreters, Eduardo Mendieta and Dianna Taylor, to do so.
